The law ministry has recommended introduction of penal provisions in the
Public Funded R&D (Protection, Utilisation and Regulation of Intellectual
Property) Bill of 2007 to prevent misuse of intellectual property by scientists.
The Bill intends to allow public sector R&D organisations to commercialise
their inventions and share their profits with the inventor.

Sources indicate that the
law ministry’s opinion was based on the premise that in exclusion of the
penal provisions, the proposed Bill will not be sound. It is understood that
incorporating penalty provisions in the proposed bill will act as a deterrent
for scientists from infringing their rights to reap profits out of their
inventions.
